Welcome to Postmate!
These Terms and Conditions ("Terms") govern your access to and use of Postmate, including the Postmate web app at https://postmate.gladiolus.dev ("Website") and the related services we provide (together, the "Service"). Postmate is operated by Gladiolus Limited, using Postmate as an app brand/trading name ("Postmate", "we", "us", or "our"). Postmate is not a separate legal entity; Gladiolus Limited is the legal operator and contracting party.
By using our Website and Service, you agree to these Terms. If you do not agree, you should not use the Service.
Postmate is a social media post scheduling tool that allows users to create, schedule, and cross-post content to multiple social media platforms from one place.
You may use the Service only if you are 18 or over and legally able to accept these Terms. Postmate is not intended for or directed at children, and we do not knowingly collect any data from children.
You may need to create an account to use Postmate. You are responsible for keeping your account secure and for activity under your account. You must provide accurate information and must not misuse another person's account.
We may suspend or terminate access if we reasonably believe you have breached these Terms, misused the Service, or created risk for us or others.
To use Postmate, you can sign in to your social media accounts and authorise access so that Postmate can schedule and publish content to the platforms you connect. Postmate currently supports Instagram, with TikTok support being added and further platforms expected over time. You are responsible for ensuring you have the right to connect each account and to post the content you schedule.
You authorise Postmate to access connected accounts and to post, schedule, and manage content on your behalf as directed by you through the Service. You can disconnect a connected account at any time, which will stop further posting to that account.
When you use Postmate to publish to a social media platform, your use of that platform is also governed by that platform's own terms and policies. For example, content you publish to Instagram is subject to Meta's and Instagram's terms, and content you publish to TikTok is subject to TikTok's terms. You are responsible for complying with the terms, policies, and automation and rate rules of each platform you connect and post to.
You retain ownership of the content you create or upload through Postmate. By connecting your social media accounts and scheduling content, you grant us the rights necessary to host, process, store, and publish that content to the platforms you connect, on your behalf and as directed by you, in order to provide the Service.
You represent and warrant that you own or control the rights to the content you submit and that publishing it through Postmate does not infringe any third party's intellectual property, privacy, publicity, or other rights, and does not breach the rules of the platforms you post to.

We use web cookies to collect non-personal data for the purpose of improving the Service and the user experience.
Postmate may offer paid plans or subscriptions. Pricing, billing period, renewal, and cancellation terms are shown before purchase. Where a subscription renews automatically, it continues until cancelled in accordance with the applicable cancellation process.
We offer a full refund within 24 hours after the purchase. To request a refund, please contact us at support@gladiolus.dev. Nothing in this section limits any statutory rights or consumer remedies that cannot be excluded under applicable law.
We own or license all intellectual property rights in the Service, including the website, app, text, graphics, branding, databases, and software, excluding third-party materials and your content. Postmate is licensed, not sold. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms.
We may change, suspend, modify, restrict, or remove features of the Service at any time. We do not guarantee uninterrupted availability or that scheduled posts will always publish successfully, as publishing depends on third-party platforms, their APIs, and their availability.
You may stop using the Service at any time. We may suspend or terminate your access if we reasonably believe it is necessary to protect users, comply with law, protect our systems, or enforce these Terms. Sections that by their nature should survive termination will continue to apply.
To the fullest extent permitted by law, the Service is provided "as is" and "as available". We make no representation or warranty that the Service will be accurate, complete, secure, available, uninterrupted, or that scheduled content will be published on time or at all. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud.
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive loss, or for any loss of profits, business, opportunity, goodwill, or data. To the fullest extent permitted by law, our total aggregate liability arising out of or in connection with the Service or these Terms will be limited to the greater of the total amount you paid us for the Service in the 12 months before the event giving rise to the claim, or GBP 100.
We may update these Terms from time to time. The updated version will be posted on our website, and users may be notified of material changes via email. Your continued use of the Service after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of England and Wales, unless mandatory consumer law in your country of residence requires otherwise. The courts of England and Wales will have jurisdiction, except where applicable consumer law provides otherwise.
